Train Gifts Terms & Conditions - these terms and conditions apply to the use of this website traingifts.co.uk. By accessing the stated website and / or placing an order you agree to be bound by the following terms and conditions.

The stated terms apply to the use of this website and any sale of goods from us to you, thereby entering into a contract for us to supply goods to you. We advise that you read these terms and conditions carefully  and make sure you understand them before using this website. Accessing and using this website indicates that you accept these terms and conditions regardless if you place an order or not.

We reserve the right to amend these terms and conditions. These terms and conditions were last updated on 20/04/2021.

1. Who We are - Train Gifts is a trading name of Black Rock Model Rail Company Limited, a registered company. Our registered office address is - The Old Observer Building, Telford Road, St. Leonards on Sea, East Sussex TN38 9LY.

If you do contact us please include details so that we can identify your order such as order number, your name etc.


1b. How We Will Contact You - Our primary contact method will by email, but if due to time frames a quicker form of contact is necessary we will telephone.

2. Train Gifts Products - Although we make every effort to ensure accuracy on our website all images are for illustrative purposes only. Colours can vary from computer to computer and we cannot guarantee that your computer accurately shows the true colour of a product. The product you receive may vary from the images.

2b. Packaging of individual products may vary from that shown in images on the website dependant on stock availability and packaging received from our suppliers.

2c. Although we make every effort to be accurate in terms of product weight, size and dimensions these may vary and be different to the specifications shown on the website and on your order.

3. Personalised Items - Once an order for personalised items has been processed you will be unable to make changes or cancel your order

3b. For personalised items please ensure and check that all spelling is accurate before placing your order. If you make a spelling error on a personalised item you will not be entitled to a refund once the item has been processed. The option to amend errors follows the same process as previously stated you must contact us on the day the order is placed, once orders are processed no changes can be made and you will be charged for the item.

4. Clothing - please ensure that when trying on ordered items of clothing that you are not wearing deodorant, perfume or aftershave which may mark or leave scents or stains on the clothing. We will be unable to accept the return of any clothing item which bears evidence that this instruction has not been followed. All clothing products should be returned in the original packaging with any tags still attached.

5. Registration on Our Website - To register on our website you must be 18 years of age or over.

5a Registration is for the named user only and sharing and use of usernames and passwords with multiple parties is not permitted.

5b The responsibility for the security of passwords for use of this website rests with you and if you suspect or know that someone else knows your password you should contact us.

5c. We reserve the right to suspend or cancel your registration if you breach the terms and conditions of this website.

6. Your Personal Information - how we use your personal information is set out in our privacy policy, a link to our privacy policy can be found at the foot of this page. Please do take time to read our privacy policy and how it relates to you.

7. Placing an Order on Our Website - After choosing your products follow the checkout instructions to make payment, once we receive your order with full payment (including any delivery charges) we will send you an order acknowledgment email. This email will detail the products in your order. Your order will then progress to fulfilment it is at this point that your order will be accepted by us.

7a If we are unable to accept your order we will inform you by email. Examples of reasons why this may happen include but are not limited to a product is now out of stock or found to be damaged, we cannot meet your requested delivery date or there has been an error in price on the website. If this occurs and none of the items on your order can be fulfilled we will refund your order amount in full including delivery charges.

If you have multiple items on the order and we can fulfil one or more of these items we will refund the unavailable item in full but not the available items or delivery charge.

7b We may refuse an order in the following circumstances:

i) if the product(s) are unavailable

ii) if the products are found to be damaged

iii) if we cannot authorise your payment

iv) if we find a pricing error on the website or the products description is wrong

v) if we cannot meet your specific delivery request

vi) if you place your order from outside of the UK

vii) if you place an order for a personalised item and we deem the wording of the personalisation to be offensive or in poor taste 

viii) if we believe your order is for commercial purposes

7c We reserve the right to cancel an order at any time and issue a full refund.

8. Our Right to Change the Terms & Conditions - we have the right to make changes to these terms and conditions, any changes will be made on this page and the date of the amendments recorded.

8a When you place an order on our website the terms & conditions which apply to the order are those as stated on this page on the date of the order.

8b If you do not wish to accept any new terms and conditions after notice is given, you should not continue to use our website.

8c If we make changes to the terms and conditions whilst you have an open order which has not yet been delivered, we will let you know of any changes which may affect you in writing (by email). You would then have the right to cancel your order if you did not agree with the new terms and conditions. We would refund your order in full (including delivery charges) with the only exception being personalised items which had already been made.

9. Your Consumer Right to Return and Receive a Refund - you have the right to return a item to us for a full refund of the product price (not including delivery charges) if you change your mind about an item or items you have ordered. The items must be returned in the good condition they were received and be in the original packaging.

9a To request a refund please contact us in writing by email with details of the item you would like to return and order number. You have the right to return an item any time within the first 14 days after receiving your item. After this 14 day period you are no longer entitled to a return and refund, in these circumstances please contact us in writing and we will consider the circumstances of your request.

9b However where personalised items have been purchased the same right to return and refund does not apply.

9c Once your item has been returned and received by us we will -

i) confirm the item has been returned in good condition with original packaging. We reserve the right to reduce the refund amount if the product has any damage that would reduce it's value.

ii) Refund the cost of the item back to your original payment method (not including delivery charges).

iii) Notify you by email that your item has been received and refund has been processed.

9.d If you are returning a product which arrived to you damaged or faulty, we will ask you to follow the same process. Notify us by email of your intention to return the item, with details of the fault / damage and your order number. We would then request that you return the item to us by the cheapest delivery option possible (Royal Mail 2nd Class), once received we will issue a full refund including all delivery costs.

10 - Returns and Exchanges - if you would like to return an item for an exchange please notify us in writing (by email) with details of the products you would like to exchange. We will then confirm details of the exchange with you in writing (by email) including any additional delivery charges to be paid. The returned product should be sent to us in the good condition it was received and in the original packaging. Once the returned item is received and any additional delivery or product costs are paid we will process the exchange and send the new product out for delivery.

11 - Delivery - Our aim is to deliver products in your order to you in a timely manner but circumstances beyond our control can result in longer delivery times. We will deliver orders within a maximum of 28 days after the date of your order.

11a we can only deliver orders to the address stated in the checkout process of the order and we cannot change the address once the order is placed. It is fine to use a different delivery address to the billing address where you would like items sent direct to a friend or relative.

11b We accept no responsibility for the non-delivery of items where you have made a mistake when adding delivery address details to an order on our website.

11c If you are not at home when the delivery person attempts to deliver your order and they leave a card, please follow their instructions to rearrange delivery. Failure to do so will ultimately result in the order being returned to us - if this happens you will be liable for delivery charges to re-send the order to your address.

11d For UK addresses in remote or offshore locations delivery times may be longer and may incur extra delivery charges.

11e If your items do not arrive please contact us in writing (by email) within the 28 day period as stated in point 11 of these terms and conditions. Failure to do so will mean we accept no liability for the loss. 

11f Our delivery carrier of choice is Royal Mail, please be aware of their stated delivery times for the following services -

i) Royal Mail Tracked 48 - second class service, delivery in 2 - 3 working days

ii) Royal Mail Tracked 24 - 1st class service, delivery in 1 - 2 working days

iii) Royal Mail 1st Class - delivery in 1 - 2 working days

11g If your items do not arrive please do check with your local sorting office. Royal Mail do not consider an item lost until a certain number of days have passed. These dates are as follows -

i) Royal Mail Tracked 48 - 14 working days from the date of dispatch

ii) Royal Mail Tracked 24 - 10 working days from the date of dispatch

iii) Royal Mail 1st Class - 14 days from the date of dispatch

Once these dates have elapsed then please notify us in writing (by email) and we will deal with the loss on your behalf.

11h All our delivery charges can be found on the Delivery page on the menu at the bottom of this page.

11i International delivery - we do not deliver to addresses outside of the UK

12 . Prices on Our Website - all prices on our website are inclusive of VAT at the current UK rate set by the UK government.

12a Despite our best efforts there may be instances when a price is incorrectly shown on the website. In this instance if you order an item which has been incorrectly priced we will contact you and give you reasonable option to continue with the order or change your order.


12b Prices of products are exclusive of delivery costs and delivery will be added to the final total during the checkout process.


13 - Events Outside of Our Control - we will not be liable for any failure to fulfil a contract in the instance of events outside of our control which could affect our ability to operate the website, fulfil orders, restock products from our suppliers or access deliver carriers services.


13a - such instances could include but are not limited to - industrial action, civil unrest or riot, terrorist incidents, effects of a national pandemic, failure of telecommunications supplier, failure or disruption to road, rail or aircraft networks, disruption to postal services.

14 - Disclaimer - Whilst we make every effort to ensure all information on this website is true and accurate, we accept that mistakes occur and we reserve the right to make changes where necessary to do so.

15 - Our Products - are only supplied for domestic and private use. By using this website you agree not to use any items for commercial, business or resale purposes. 

16 - Law - These terms and conditions are governed by UK law and by using this website you accept that any dispute relating to products or orders will be governed by English law.
